《2014年國家知識產權戰(zhàn)略實施推進計劃》中英文
為貫徹黨的十八大和十八屆三中全會精神，落實全國知識產權戰(zhàn)略實施工作電視電話會議要求，推動國家知識產權戰(zhàn)略深入有效實施，明確2014年戰(zhàn)略實施重點任務和措施，制定本計劃。
一、提高知識產權創(chuàng)造質量
目標任務：完善知識產權考核評價體系，提高知識產權創(chuàng)造的針對性和有效性。優(yōu)化有利于提升專利申請質量的政策導向，加強專利申請質量監(jiān)管。改進各類知識產權審查工作，強化質量管理，提高審查效率。提升創(chuàng)新主體知識產權創(chuàng)造能力，加強重點領域知識產權布局。
工作措施：
1.落實《關于進一步提升專利申請質量的若干意見》，優(yōu)化區(qū)域專利評價工作導向，完善專利一般資助政策，推行專利專項資助政策，突出專利獎勵政策的質量導向，推動專利申請質量指標納入相關政策。
2.建立有利于提升專利申請質量的監(jiān)管機制，強化對低質量專利申請的監(jiān)控和處理，建設專利申請主體信用檔案庫，嚴肅處理套取專利資助和獎勵資金行為，探索建立專利申請質量監(jiān)測和反饋機制。
3.提高商標注冊工作效率，加強商標審查質量管理，確保商標審查周期控制在9個月內，異議審理周期控制在12個月內。
4.推動落實《關于進一步規(guī)范作品登記程序等有關工作的通知》，促進作品登記、計算機軟件著作權登記、質權登記等各項版權登記工作開展。
5.建立林業(yè)知識產權試點示范，完善試點單位考核評價體系，引導試點單位提升知識產權質量。
6.在戰(zhàn)略性科技先導專項和重大項目中試點推進核心知識產權培育工作，探索建立中科院知識產權質量監(jiān)測指標體系，發(fā)布知識產權質量年度報告。
7.選擇國防關鍵技術，組織開展專利態(tài)勢分析，引導知識產權布局，形成優(yōu)勢知識產權組合。
二、提升知識產權運用效益
目標任務：強化知識產權政策與產業(yè)、區(qū)域政策的銜接，推進戰(zhàn)略性新興產業(yè)知識產權工作，研究我國知識產權密集型產業(yè)的發(fā)展規(guī)律和培育政策。完善以知識產權為核心和紐帶的創(chuàng)新成果轉化運用機制，實施促進知識產權轉移轉化的政策措施，推動知識產權成果產品化、商品化和產業(yè)化。
工作措施：
8.加快促進戰(zhàn)略性新興產業(yè)的培育和發(fā)展，加強戰(zhàn)略性新興產業(yè)知識產權集群式管理，發(fā)布國家戰(zhàn)略性新興產業(yè)專利發(fā)展報告。
9.開展知識產權密集型產業(yè)基礎研究，明確知識產權密集型產業(yè)范圍，探索建立符合中國國情的知識產權密集型產業(yè)目錄和統(tǒng)計規(guī)范。
10.推動《促進科技成果轉化法》修訂，推動科研機構和高等院校建立技術轉移工作體系，改革和完善中央級事業(yè)單位科技成果處置和收益分配制度，啟動國家科技成果轉化引導基金，積極推動產業(yè)技術創(chuàng)新戰(zhàn)略聯(lián)盟專利共享和成果轉化。
11.提升工業(yè)知識產權運用能力，宣傳貫徹《工業(yè)企業(yè)知識產權管理指南》，制定企業(yè)知識產權運用能力評估指標，支持地方圍繞工業(yè)轉型升級關鍵環(huán)節(jié)開展特色產業(yè)或區(qū)域知識產權運用試點工作。
12.研究制定《種業(yè)科技成果產權展示交易平臺管理辦法》，發(fā)布相關展示交易信息，推行交易規(guī)范合同、交易章程和規(guī)則。
13.建立林業(yè)植物新品種與專利技術展示和對接平臺，實施林業(yè)知識產權產業(yè)化推進工程；篩選一批授權優(yōu)良植物新品種，納入各級林業(yè)科技計劃進行轉化運用；構建林業(yè)重點領域知識產權戰(zhàn)略聯(lián)盟。
14.加強國家版權貿易基地建設，支持辦好2014年中國國際版權博覽會、福州海峽版權（創(chuàng)意）產業(yè)精品博覽交易會等大型版權貿易展會。
15.加快實施專利導航試點工程，在3個專利導航實驗區(qū)開展專利導航分析項目，探索建立專利分析與產業(yè)運行決策深度融合的工作機制；在2-3個產業(yè)關鍵技術領域培育專利儲備運營項目。
16.推進知識產權金融服務，加強知識產權質押融資、投融資、專利保險等工作，在知識產權示范園區(qū)推動建立專利轉移轉化服務機制，推進專利價值分析指標體系應用。
17.制定有關國防知識產權權利歸屬與利益分配的政策意見，開展國防知識產權運用試點，促進國防知識產權轉化運用。
18.起草促進國防領域和民用領域知識產權相互轉化的相關政策，編制發(fā)布知識產權轉化實施目錄，開展知識產權轉化實施試點示范工作，推動知識產權軍民雙向轉化實施。
三、提高知識產權保護效果
目標任務：完善知識產權立法，加強知識產權保護長效機制建設。推進知識產權審判體系建設，提高司法保護力度。提升知識產權行政執(zhí)法能力，針對重點領域、重點區(qū)域、重點環(huán)節(jié)開展專項執(zhí)法行動和維權援助工作。推進知識產權糾紛調解工作開展，健全多元化糾紛解決機制。強化網(wǎng)絡環(huán)境下的知識產權保護，提升對傳統(tǒng)優(yōu)勢領域知識產權資源的保護水平。
工作措施：
19.推進著作權法、專利法、商標法實施條例、職務發(fā)明條例等法律、行政法規(guī)的制定修改。
20.起草完成《關于審理侵犯專利權糾紛案件應用法律若干問題的解釋（二）》、《關于修改〈關于審理專利糾紛案件適用法律問題的若干規(guī)定〉的決定》、《關于審理商標民事糾紛案件適用法律若干問題的解釋》、《關于審理商標授權確權行政案件若干問題的規(guī)定》、《關于知識產權訴前行為保全適用法律若干問題的解釋》。
21.繼續(xù)推進《創(chuàng)新藥物保護管理規(guī)定》的起草與制定工作，加強創(chuàng)新藥物保護。
22.探索建立知識產權專門法院，優(yōu)化知識產權保護體制，健全創(chuàng)新激勵機制。
23.健全行政執(zhí)法與刑事司法銜接機制，完善中央級信息共享平臺，加快建立省級以下信息共享平臺，推進平臺間對接互聯(lián)，實現(xiàn)案件的有效移送和反饋。依法公開制售假冒偽劣商品和侵犯知識產權行政處罰案件信息。
24.研究制定《政府機關使用正版軟件管理辦法實施意見》，開展軟件正版化督促檢查，做好市、縣政府機關軟件正版化驗收工作，以國有企業(yè)、金融機構、大型外資和民營企業(yè)及新聞出版行業(yè)等為重點，深入推進企業(yè)使用正版軟件，引導企業(yè)加強軟件資產管理，開展計算機預裝正版操作系統(tǒng)軟件專項檢查。
25.開展知識產權反壟斷調查，對濫用市場支配地位拒絕許可、高價許可、反向支付，以及利用專利池達成價格壟斷協(xié)議排除、限制競爭等行為適時啟動反壟斷調查。
26.重點打擊社會影響大、群眾反映強烈的制售假藥品、假食品、假農資、假日化、假機電等犯罪活動，完善集群戰(zhàn)役信息化作戰(zhàn)機制，以打假溯源技術應用為重點，帶動警企協(xié)作機制建設，加快推進物流信息、行政執(zhí)法信息共享，完善實戰(zhàn)應用機制。
27.強化網(wǎng)絡環(huán)境下的知識產權保護，針對利用互聯(lián)網(wǎng)銷售侵權假冒重點商品開展專項整治。
28.開展第十次打擊網(wǎng)絡侵權盜版“劍網(wǎng)行動”，針對網(wǎng)絡侵權盜版行為進行專項治理。
29.實施“專利行政執(zhí)法能力提升工程”，建立健全知識產權維權援助與舉報投訴、專利執(zhí)法協(xié)作調度、專利糾紛快速調解和專利侵權判定咨詢機制，推進專利行政執(zhí)法辦案能力提升，加強知識產權維權援助舉報投訴平臺建設，完善執(zhí)法維權工作績效考核指標體系。
30.推動知識產權爭議調解仲裁機制建設，培育一批有公信力的知識產權爭議調解仲裁機構，加強引導，發(fā)揮人民調解、行政調解和仲裁在解決知識產權爭議中的作用。
31.積極拓展知識產權公證業(yè)務領域，加快構建完善的知識產權預防性保護機制。
32.加強專業(yè)市場知識產權保護，培育形成一批引領示范型的專業(yè)市場，推動建立專業(yè)市場知識產權保護評價體系。
33.完善自由貿易區(qū)知識產權保護，探索轉運貨物涉嫌侵犯知識產權的監(jiān)管機制。
34.研究知識產權保護社會信用評價的基本準則，完善社會征信體系。
35.加強商標行政執(zhí)法區(qū)域、部門協(xié)作，重點查辦跨區(qū)域、大規(guī)模、社會反映強烈的商標侵權案件，嚴厲打擊“傍名牌”行為，進一步健全商標保護長效機制。
36.重點開展針對大型網(wǎng)絡內容提供平臺的版權主動監(jiān)管，適時擴大主動監(jiān)管范圍，完善長效工作機制，進一步規(guī)范互聯(lián)網(wǎng)傳播作品的版權秩序。
37.健全地理標志工作協(xié)調機制，推動地理標志聯(lián)合認定和保護，探索開展對地理標志的授權、管理和保護作出統(tǒng)一規(guī)定的立法研究。
38.開展打擊侵犯植物新品種權和制售假劣種子行為專項行動。
39.繼續(xù)推動《生物遺傳資源獲取與惠益分享管理條例》立法進程，實施加強生物遺傳資源獲取與惠益分享國家工作方案。
40.發(fā)布《中醫(yī)藥傳統(tǒng)知識保護研究綱要》，開展全國中醫(yī)藥傳統(tǒng)知識調查，初步構建中醫(yī)藥傳統(tǒng)知識保護名錄和數(shù)據(jù)庫。
41.開展民間文學藝術數(shù)據(jù)庫上線傳播工作，繼續(xù)探索建立民間文藝保存人與后續(xù)創(chuàng)作人之間合理分享利益的機制。
42.加大對海關知識產權大要案的查處力度，加強執(zhí)法統(tǒng)一性建設，升級完善“知識產權海關保護執(zhí)法系統(tǒng)”，支持成立國內自主知識產權企業(yè)保護區(qū)域聯(lián)盟，開展出口知名品牌企業(yè)知識產權海關保護情況調查。
43.加快修訂《國防專利條例》，強化國防知識產權保護，開展國防知識產權保護試點。
四、提升知識產權管理和公共服務水平
目標任務：以創(chuàng)造良好發(fā)展環(huán)境和提供優(yōu)質公共服務為重點，完善知識產權管理和公共服務體系。推進知識產權公共信息服務平臺建設，提高信息公開水平。推動重大經(jīng)濟活動知識產權評議機制建設，加強重點領域知識產權信息分析和預警。促進企業(yè)、高校、科研院所提升知識產權管理能力。
工作措施：
44.出臺加強和改善知識產權管理工作的政策文件，完善知識產權管理體制機制，提高政府、行業(yè)、企業(yè)、高校、科研機構和服務機構等的知識產權管理水平。
45.加快修訂《關于加強國家科技計劃知識產權管理工作的規(guī)定》，貫徹落實《國家科技重大專項知識產權管理暫行規(guī)定》，繼續(xù)推動國家科技重大專項制定發(fā)布知識產權管理細則，完善國家科技計劃和重大專項知識產權信息登記、統(tǒng)計和評估制度。
46.研究修訂高校院所知識產權管理相關政策文件，制定高等院校和科研組織知識產權管理標準，完善高校知識產權管理體系。
47.設立重點產業(yè)和關鍵技術領域知識產權風險評估與預警項目，組織重點產業(yè)知識產權預警態(tài)勢發(fā)布；研究建立關鍵技術領域知識產權風險應對與預警機制。
48.推進重大經(jīng)濟活動知識產權評議工作，研究制定知識產權分析評議規(guī)范，提升知識產權分析評議服務機構的服務能力。
49.組建全國知識管理標準化技術委員會，建立健全知識管理國家標準體系，研究提出國家標準制修訂計劃項目，引導企業(yè)實施《企業(yè)知識產權管理規(guī)范》，組織實施知識產權管理體系認證活動，加快培育國家級知識產權示范企業(yè)和優(yōu)勢企業(yè)，實施中小企業(yè)知識產權戰(zhàn)略推進工程，開展中小微企業(yè)知識產權托管。
50.推進全國專利信息公共服務體系建設，研究制定進一步開放專利基礎數(shù)據(jù)資源的方案，完善《全國專利信息公共服務指南》。
51.推進“金農工程”農產品地理標志信息系統(tǒng)和相關數(shù)據(jù)庫建設，推動農業(yè)知識產權平臺建設，開展國內外農業(yè)知識產權信息分析、價值評估和知識產權預警，定期發(fā)布《中國農業(yè)知識產權創(chuàng)造指數(shù)報告》。
52.發(fā)布實施并宣傳貫徹《國家標準涉及專利的管理規(guī)定（暫行）》，發(fā)布配套國家標準《標準制定的特殊程序第1部分：涉及專利的標準》。
53.深化司法鑒定管理體制改革，推動將知識產權司法鑒定納入統(tǒng)一登記管理范圍，探索建立司法鑒定科技專家?guī)臁?/span>
54.優(yōu)化知識產權統(tǒng)計分析指標體系，研究在科技、貿易等相關統(tǒng)計年鑒中增加知識產權指標，研究建立知識產權密集型商品進出口統(tǒng)計制度，推動將知識產權納入經(jīng)濟發(fā)展質量統(tǒng)計監(jiān)測，在修訂的國民經(jīng)濟核算體系中加強知識產權產品的統(tǒng)計核算。
五、促進知識產權國際交流
目標任務：完善知識產權對外信息交流與應對機制，積極參與知識產權國際秩序構建，提升知識產權對外工作水平。加強與國際組織和主要國家的交流與合作，提高處理知識產權國際事務的能力和主動性，擴大知識產權國際影響力。拓展企業(yè)對外發(fā)展空間，加強對企業(yè)海外維權的指導和服務。
工作措施：
55.通過多雙邊交往，就外方關注的知識產權保護問題做好增信釋疑工作，做好世界知識產權組織在華辦事處開辦后續(xù)工作，做好有關公約談判和條約審核工作，積極參與知識產權國際秩序構建。
56.完善知識產權對外信息交流與合作，繼續(xù)發(fā)揮現(xiàn)有雙邊對話和工作組機制的作用，開展知識產權海外交流。推動落實《中美知識產權合作框架協(xié)議》和中歐新的知識產權合作項目，力爭盡快結束中歐地理標志談判，組織做好中韓、中日韓等自由貿易協(xié)定知識產權章節(jié)談判。
57.加強海外知識產權應對機制建設，探索建立支持企業(yè)和產業(yè)國際化發(fā)展的知識產權工作體系，完善海外知識產權信息平臺建設，構建海外知識產權服務機構圈，在更多的國外大型展會設立中國企業(yè)知識產權服務站，調動和整合駐外機構、國內地方和社會資源為企業(yè)提供服務。
58.做好《國際植物新品種保護公約》（UPOV）履約工作，完善履約對案，爭取承擔UPOV測試指南編制任務，做好兩岸間的植物新品種保護工作交流合作。
59.研究加入《生物多樣性公約遺傳資源獲取和惠益分享議定書》相關事宜，加強后續(xù)談判議題研究，籌備政府間會議及締約方大會。
60.研究加入《糧食和農業(yè)植物遺傳資源國際條約》。
61.積極參與外觀設計法條約等國際規(guī)則的磋商和談判，推動中國加入《工業(yè)品外觀設計國際保存海牙協(xié)定》相關籌備工作，進一步擴展專利審查高速路合作網(wǎng)絡，拓展企業(yè)海外申請便利渠道，完善知識產權對外信息交流與應對機制。
62.推進落實我國加入《視聽表演北京條約》有關工作，積極開展我國加入《關于為盲人、視力障礙者或其他印刷品閱讀障礙者獲得已出版作品提供便利的馬拉喀什條約》相關工作。
63.結合國際輿論關切，及時介紹我國推進知識產權戰(zhàn)略實施的政策措施，反映我國加強知識產權保護、打擊侵權假冒行為的堅定決心和顯著成效。
六、提升知識產權基礎能力
目標任務：加快發(fā)展知識產權服務業(yè)，引導服務機構業(yè)務向專業(yè)化、品牌化、國際化發(fā)展。加大知識產權人才培養(yǎng)力度，完善知識產權專業(yè)人員評價標準，促進高層次人才向知識產權領域聚集。創(chuàng)新知識產權宣傳教育模式，推動知識產權文化建設，提升社會公眾的知識產權整體素質。
工作措施：
64.制定全國知識產權服務標準化體系建設指導意見，開展全國知識產權服務業(yè)統(tǒng)計調查，推進國家知識產權服務業(yè)集聚發(fā)展試驗區(qū)建設和全國知識產權服務品牌機構培育工作。
65.推進《專利代理條例》修訂工作，研究制定專利代理行業(yè)發(fā)展中長期規(guī)劃，出臺專利代理行業(yè)發(fā)展的促進政策，建立專利代理行業(yè)服務標準，完善專利代理人資格考試制度。
66.完善高層次人才回國各項優(yōu)惠政策，通過各項引才計劃重點引進緊缺的知識產權相關海外高端留學人才；對各級各類留學人員創(chuàng)業(yè)園加強指導，重點支持留學人才以自主知識產權創(chuàng)辦高新技術企業(yè)。
67.建立國家知識產權人才培養(yǎng)基地，推動知識產權研究的協(xié)同創(chuàng)新，指導相關卓越法律人才教育培養(yǎng)基地加強高素質知識產權專業(yè)人才培養(yǎng)工作，完善高等院校、職業(yè)院校知識產權學科專業(yè)課程體系，開設知識產權相關領域輔修課程，深入開展中小學知識產權宣傳教育。
68.落實《關于加強知識產權人才體系建設的意見》，將知識產權領域相關職業(yè)納入國家職業(yè)分類大典，建立和完善知識產權專業(yè)技術人才評價體系，將知識產權專業(yè)人才納入職稱評價范圍，加強人才水平評價，促進人才成長發(fā)展和合理流動。
69.構建國防科研項目知識產權專員體系，逐步建立國防知識產權專員隊伍，探索建立專員資質認證及培訓考核機制；制定中科院知識產權專員管理辦法，明確知識產權專員的工作職責、職業(yè)發(fā)展規(guī)劃。
70.圍繞重要時間節(jié)點和相關活動，組織新聞媒體開展知識產權專題宣傳；加強網(wǎng)上宣傳報道，組織中央媒體及中央重點新聞網(wǎng)站、主要商業(yè)門戶網(wǎng)站等，充分運用新媒體，提升宣傳引導效果。
71.將知識產權法制宣傳與“法律六進”活動結合，廣泛普及知識產權保護法律知識，在中國普法官方微博集中開展知識產權專題法制宣傳，指導各地普法網(wǎng)站組織開展形式多樣的知識產權法制宣傳活動。
七、提高知識產權戰(zhàn)略組織實施水平
目標任務：加強知識產權戰(zhàn)略深化實施的總體謀劃和頂層設計。完善各領域和區(qū)域知識產權戰(zhàn)略規(guī)劃與部署，推動知識產權戰(zhàn)略實施有效融入各領域和區(qū)域經(jīng)濟發(fā)展。加強知識產權戰(zhàn)略實施部際聯(lián)席會議機制建設，加大戰(zhàn)略組織實施力度。
工作措施：
72.制定發(fā)布《深化實施國家知識產權戰(zhàn)略行動計劃 （2014-2020年）》。
73.加強知識產權戰(zhàn)略實施工作體系和平臺建設，推動知識產權戰(zhàn)略指標納入地方績效考核體系，適時開展知識產權戰(zhàn)略實施情況督導檢查。
74.啟動“十三五”知識產權工作規(guī)劃編制研究工作。
75.按照分類指導要求深入推進區(qū)域知識產權戰(zhàn)略實施，進一步加強首都經(jīng)濟圈、環(huán)渤海地區(qū)等國家重點區(qū)域規(guī)劃和重大政策與知識產權政策的銜接，建立和完善區(qū)域知識產權合作機制，推動部分有條件的省份建設知識產權強省。
76.啟動國防知識產權戰(zhàn)略十三五規(guī)劃編制，完善戰(zhàn)略實施組織體系和工作機制建設。
77.啟動文化系統(tǒng)知識產權戰(zhàn)略指導性文件的研究制定工作。
78.印發(fā)《關于加強醫(yī)藥衛(wèi)生和計劃生育知識產權工作的指導意見》，并推動實施。
79.完成地方知識產權戰(zhàn)略實施階段性總結評價工作，形成地方知識產權戰(zhàn)略實施發(fā)展報告。
The Promotion Plan for the Implementation of the National Intellectual Property Strategy in 2014
Office of the Inter-Ministerial Joint Meeting for Implementation of the National Intellectual Property Strategy
This plan is promulgated to implement the requirements of the 18th National Congress of the Communist Party of China（CPC） and the 3rd Plenary Session of the 18th CPC Central Committee, carry out the requirements of the national television and telephone conference on implementing intellectual property strategy, promote the deep and efficient implementation of the national intellectual property strategy, identify the primary goals and measures for the implementation of the strategy in 2014.
I. Raising the Intellectual Property （IP） Creation Quality
Goals:
Improving IP performance evaluation system, raising the pertinence and efficiency of the IP creation. Optimizing the policy orientation for improving the quality of patent application, strengthening the supervision on the quality of patent applications. Improving examinations of various IP types, strengthening the quality management, raising the examination efficiency. Upgrading the creation capability of IP innovators, enhancing IP layout in key fields.
Measures:
1. Implement the Opinions on further Improving the Quality of Patent Applications, optimize the orientation of regional patent evaluation, improve general policy on patent subsidizing, implement special patent subsidizing policy, highlight the quality orientation of patent awarding policy, promote the integration of quality index of patent applications into relevant policies.
2. Establish the supervision system for facilitating the quality improvement of patent applications, strengthen the monitoring and handling of low quality patent applications, develop the credit database of patent applicants, seriously handle the cases involving swindling patent subsidies and awards, explore to establish the quality monitoring and feedback system of patent applications.
3. Raise the trademark registration efficiency, strengthen the quality management of trademark examination, ensure the trademark examination pendency below 9 months and the disagreement review pendency below 12 months.
4. Promote the implementation of the Notice on further Standardize the Copyright Registration Procedure and Relevant Works, improve registration of various copyrights, such as literatures, computer software, and hypothecations.
5. Establish the pilot and demonstration projects on forestry IP, improve the performance evaluation system on pilot units, guide the pilot units to raise IP quality.
6. Promote the core IP cultivation in the strategic technology-led projects and major projects, explore the establishment of IP quality supervising index system in China Academy of Science, publish the annual report on IP quality.
7. Select key technologies of national defense, organize analysis on patent status and trends, guide the IP layout, form IP portfolios with advantages.
II. Upgrading the Effectiveness of IP Utilization
Goals:
Strengthening the connection between IP policies and industrial, regional policies, promoting the IP in strategic emerging industries, conduct study on the development mode and the cultivation policy relating to Chinese IP-intensive industries. Refining the transformation and utilization mechanisms for IP-cored and IP-based innovations, implementing the policies and measures facilitating the IP transfer and transformation, promoting the materialization, commercialization and industrialization of IP rights.
Measures:
8. Accelerate the cultivation and development of strategic emerging industries, strengthen the aggregated IP administration of strategic emerging industries, publish patent development report on national strategic emerging industries.
9. Carry out the fundamental research on IP-intensive industries, identify the scope of IP-intensive industry, explore the establishment of catalogue and statistical specifications for IP-intensive industry in line with China’s own conditions.
10. Promote the revision of the Law of the PRC on Promoting the Transformation of Scientific and Technological Achievements, promote the research institutions and colleges to establish technology transfer system, reform and refine the management and distribution system for scientific and technological achievements in central public institutions, set up national guidance fund for the transformation of scientific and technological achievements, actively promote the patent sharing and achievement transformation in the strategic alliance for industrial technology innovations.

Complete the drafting of the Interpretation on Several Issues Concerning the Application of Law in the Trial of Patent Infringement Disputes （II）， Decision on Amendments to the Interpretation on Several Issues Concerning the Application of Law to the Trial of Patent Dispute Cases, Interpretation on Several Issues Concerning Applicable Law in the Trial of Trademark Civil Disputes, Provisions on Several Issues Concerning Applicable Law in the Trial of Trademark Granting and Confirmation Administrative Cases, Interpretation on Several Issues Concerning the Applicable Law in IP Attachment before the Institution of an Action.

50. Promote the construction of national patent information public service system, study and formulate the plan for further disclosure of patent basic data resources, refine the National Guidelines for Patent Information Public Service.

53. Further reform the management system for judicial appraisals, promote the integration of IP judicial appraisal into the unified registration management, explore the establishment of the specialist bank of judicial appraisals.

Perfecting the exchange and dealing mechanism of foreign IP information, participating in the establishment of international IP system, improving the foreign IP working capabilities. Promoting the exchanges and cooperation with international organizations and major countries, enhancing the capabilities and initiative of dealing with global IP affairs, enhancing the IP influence globally. Expanding the overseas development space for Chinese enterprises, improving the guidance and service for protecting overseas rights of Chinese enterprises.

55. Through multilateral and bilateral exchanges, improve the mutual trust and explanation on the IPR protections issues concerned by foreign side, undertake the follow-up work of the establishment of WIPO China Office, negotiate relevant conventions and review relevant treaties, participate in the construction of international IP orders.
56. Improve the foreign IP information exchange and cooperation, undertake foreign IP exchange through existing bilateral dialogs and working group mechanisms. Implement the SINO-US Intellectual Property Rights （IPR） Cooperation Framework Agreement and the new IP cooperation projects between China and EU, complete the China-EU negotiations on geographical indication as soon as possible, organize the negotiation on the IP sections in the China - Korea free trade agreement and China - Japan - Korea free trade agreement.

58. Fulfill the International Convention on the Protection of New Varieties of Plants （UPOV）， optimize the implementation plan, endeavor to conduct the compiling of the UPOV testing guideline, improve the cross-strait exchanges and cooperation on new varieties of plants protection.

64. Develop the Guiding Opinions on National Intellectual Property Service Standardization System, undertake national IP service survey, promote the construction of national experimental zone of IP service agglomeration development and the cultivation of national IP service brand.
65. Promote the revision of the Regulations on Patent Commissioning, study and formulate the middle and long-term development plan for the patent agency industry, promulgate promotion policies for the patent agency industry, establish the service standards of patent agencies, refine the qualification examination system for patent agents.
